Sorry folks, it has to be done. The below terms are included on all proposals. We welcome questions and reasonable negotiation of terms, but overall, these are here to keep both me and my clients safe.
General Terms and Conditions
The term ‘Pivotal Infrastructure’, ‘Pivotal’ or ‘us’, refers to Pivotal Infrastructure Projects, ABN 95274473946, ARN 1084052
All quotations are valid from the date of issue for 60 days unless otherwise specified.
All pricing is subject to change without prior notice.
Errors and omissions excepted
Once a proposal document is signed, it will be accepted as a purchase order and invoicing will commence as per the schedule set out in section (3), or in the case of package service, on delivery of the final package.
Any fees payable to third parties, where related specifically to the project, or hardware included in this order is required to be pre-paid in full before orders are placed with suppliers, unless previously agreed otherwise.
Unless specified otherwise, all invoices are issued on 14 day terms.
Where invoices remain outstanding, Pivotal reserves the right to suspend work or delivery against the clients products until outstanding balances are settled.
Where invoices remain outstanding beyond 28 days, a late payment charge of 5% of total outstanding value, per week overdue may be incurred.
As an artistic product, Pivotal has a specific style and format of production for all media, and will not accept refusal of delivery on grounds of stylistic difference, where the substantial goals of the proposal have been achieved.
Title and risk in the products/services provided, pass to the customer upon settlement of final accounts at the completion of each project.
Unless otherwise negotiated, Pivotal retains an unlimited licence to reasonably use and display content created in the course of executing this project for our own marketing purposes, from such time that it does not negatively affect the clients project (typically following completion of the project).
In the event of a dispute, both parties agree to use best efforts to resolve the dispute by mutual negotiation in the first instance. Where arbitration is required, it will be conducted in NSW, Australia.
